REGULAR MEETING OF THE NORTH HORNELL VILLAGE BOARD NOVEMBER 14, 2011 7PM

Mayor Falci opened the meeting at 7PM with the pledge of allegiance.
MAYOR’S OPENING REMARKS
Mayor Falci introduced Mr. Jim Dodge to the board. Mr. Dodge would like to see the Village dedicate and name the new Fire Hall & Safety Building to the memory of Viet Nam Veteran Joseph Barillo who was killed in action during that war. He would also like to work with the Village to improve Barillo Park. Mayor Falci asked that he return to the January 9th board meeting with suggestions on what can be done.
MINUTES A motion to accept the October minutes was made by Trustee Joseph Dick, seconded by Trustee Frank Libordi and carried. Mayor Falci Aye Trustee Thomas Aye Trustee Libordi Aye Trustee Dick Aye Trustee DiRaimondo Aye Comments: Mayor Falci noted that he had talked to Officer Smith regarding the allotted hours for police. Officer Smith said they were on schedule for their average and would not go over the budgeted hours. Trustee Libordi asked if he could have the final amount of money paid to Casey’s Plumbing for the next meeting.
TREASURER’S REPORT
A motion to accept the Treasurer’s report was made by Trustee Glenn Thomas and seconded by Trustee Peter DiRaimondo and carried. Mayor Falci Aye Trustee Thomas Aye Trustee Libordi Aye Trustee Dick Aye Trustee DiRaimondo Aye Comments: Trustee Thomas asked if we were still waiting for the total cost on the safety building refurbish. Clerk Libordi said once all the figures are available, she would report them.
POLICE REPORT OIC Smith reported the following for the month of October: Criminal complaints 1 General complaints 1 Property checks 30 UTT 2 Vehicle checks 5 Total of police hours 75 The police are continuing to watch traffic on Cleveland Ave through the school zone. Questions were raised in regards to police hours and budget. The hours where checked and they are right on track with the budget – 50% of the year has passed with 50% of wages used. The police car is starting to have problems and should consider the purchase of a new vehicle sooner than expected. An officer is needed to replace the vacancy from Officer Kilmer resigning. OIC Smith is recommending John McNelis for the position. Mayor Falci will make contact with Mr. McNelis tomorrow. The board agreed with the Mayor to bring Mr. McNelis into the Department for the rest of the budget year. OIC Smith noted that the police car will need to be replaced soon. He would like to use the $6000 put in the budget for a payment towards a new car and the balance to be paid out of next years budget in June. The Mayor directed Officer Smith to investigate costs and details on a new car and report to the board at next months meeting. DPW REPORT DPW Supervisor Zdanowski was not in attendance. Mayor Falci read the following report:
Pump station flow meter is not working and the transducer is being tested for problems (Has to do with reporting the flow to the City) Clearing leaves from catch basins Clearing land on Avondale Ave. Cleaning sewers with the vac truck A truck is ready for plowing now A motion to accept the DPW report was made by Trustee DiRaimondo, seconded by Mayor Falci and carried. Trustee Dick recommended that Lowe’s pay for it since it stopped working after they used it during their construction. Trustee Thomas asked if it belonged to the Village and Trustee Dick responded yes.
FIRE REPORT
Chief Robbins read the following report for the month of October: Fire prevention week was a success – over 300 children were at the station in one day Thank you to everyone who helped with the haunted house One member expelled for non attendance – 27 members with one application pending Christmas parade will be 17th of December Asking for the $200 from the Village to offset costs for the parade Still have tickets available for the holiday raffle – drawing on November 22nd County is using more sand with salt this year so roads will be more slippery and snow covered Switched the following jobs - Chad Hancock is now fire records and Jeremy Smith is training officer. Still updating equipment that was in the budget Jason Flaitz asked for a scout group tour on November 21 Calls for the Town 1 Calls for the Village 1 M/A 1 Fire alarm checks 3

Comments: Trustee Libordi asked if a member was suspended as well as the member expelled. Chief Robbins replied yes and that proper procedure was followed (30 day suspension) through certified mail by the fire secretary. Trustee Libordi also wanted to make note to the fire company that the entire board of trustees has the authority over the fire department and whenever they need to use any equipment it is required that they come to the board to request permission. Mayor Falci noted that he has an email from NYCOM regarding the use of equipment and board approval for the Chief to read. Trustee Thomas stated that everything including Chapman’s electric fees comes out of the $10,000 the board allotted to the fire department for renovation of the upstairs offices. Trustee Dick asked if the fire department was going to be involved with the HPG’s “Holiday Aglow”. Chief Robbins does not have information as of this date. Trustee Libordi asked firefighter Conley if he was still the secretary of the fire department. Mr. Conley said no.

CODE ENFORCEMENT REPORT
CEO Schieder handed a detailed report to the Mayor and Trustees for the month of October. Comments: Trustee Libordi questioned the Hunt Engineer report for 4th St. Mayor Falci asked when the report was done. Mr. Schieder stated that it was done before the three houses were built. Mayor Falci asked if the Hunt report and the Brad Irvine report is enough to proceed. Mr. Schieder said yes. Mr. Schieder stated that with Mr. Irvine and the Hunt report we should be able to have a way to solve the problem on 4th St. within the next few weeks. The Mayor and Mr. Schieder will visit the property at 325 Seneca Rd.

OLD BUSINESS
WORKERS COMP PREMIUM – KEN ISAMAN Mr. Isaman gave a presentation on how Workers compensation works through the County. The current formula apportionment is 60% payroll, 20%claims and 20% assessed value. The Village premium has gone up based on the payroll, claims and assessed value. The billing has change with the Village paying the premium directly to the county as opposed to the premium being levied onto the town tax. The Town tax rate is now $3.02 but would be more if the workers comp bill would be levied onto the Town tax. The county attorney has now stated that the levying should be a penalty and that Towns and Villages should be billed. Mayor Falci asked if we are going to be billed shouldn’t our Town tax go down otherwise we are paying twice. Mr. Isaman will check into this and get a better explanation from the county attorney. Mr. Isaman stated that the town does not keep the money – it goes directly to the county.
GRANT SELECTION
Records management is the grant that is coming up in January. The Mayor will contact Kathleen Dear (Stuart L Brown Assoc) to let her know that the Village will be a client. A motion was made by Trustee Libordi to give the Mayor authorization to contact Cathy Dear letting her know that the Village would like to be a client. Motion was seconded by Trustee DiRaimondo and carried. PLANNING BOARD – DPW BUILDING
Planning Board Chair Joseph Ingalls gave some highlights of the plan noting that this was only a beginning to the whole process of a new DPW building. Mayor Falci asked what the possibilities would be for a remodel of the existing building. Mr. Ingalls stated that possibly pulling the flat roof portion of the existing building and putting an extension or a metal building on with a new bathroom and office. Investing money would be a short term investment with the end result an old building and not a good investment. Mayor stated the board would favor the Chambers St. site over the Avondale property. Mr. Ingalls agreed that the planning board determined it would be the preferred location. The mayor asked if there is anything that should be addressed in the existing building with the possibility of the department staying in that location for another two years. Mr. Ingalls stated that the Planning board did a walk through out and there is a leak above the records storage area. The Mayor thanked Mr. Ingalls and the Planning Board.
SAFETY BUILDING
Two bids for cleaning the safety building. Tammy Whitney proposed $15 per hour with 3 – 4 hours per week on Saturdays. Kristene Libordi – $50 per week. Mayor Falci motioned to accept the bid from Kristene Libordi of $50 per week for cleaning the Safety Building and $30 for Debbie Pomeroy to clean the Village hall bi-weekly, seconded by Trustee Thomas and carried. NEW BUSINESS
SIGN FOR BETHESDA FOUNDATION
Mayor Falci said the sign does meet Village code but the code says it must go to the Board for approval. COE Mr. Schieder stated that Code 100-5B reads that all applications should be forwarded to the Village board for review. Trustee Thomas noted that the sign doesn’t meet code because it is not zoned commercial and it would be a mistake to let a sign go up in a residential area. CEO Schieder said that it is zoned as a special use permit. The sign would be located on the corner of Bethesda and Cleveland Ave in front of the house. Trustee Thomas asked when they were granted a special permit. CEO Schieder didn’t know when the permit was given, only that they have had it for some time. The board agreed that they needed more information from Mr. Marks regarding the size and location and the concerns of the board. Possibly it could be moved to the back of the property near Lowe’s. The clerk was directed to send Mr. Marks a letter informing him of the board’s decision and inviting him to next months meeting.
VEHICLE STORAGE
Mr. James Kendter would like to store a trailer on property he is purchasing in the Village. It will be in a wooded area with no neighbors closer than 200’. Trustee Dick stated that Mr. Kendter will have to show proof of ownership before the board can give its approval for a permit. Trustee Dick also noted that Mr. Kendter cannot discharge fire arms in the Village and should be made aware of the code. A motion was made by Mayor Falci to grant a 6 month storage permit to Mr. Kendter in the amount of $50, with proof of ownership given at the same time. After the 6 month period the board will revisit the request for an extension. Motion was seconded by Trustee Libordi and carried. The board directed the clerk to contact Mr. Kendter. OTHER
COLLECTION OF UNPAID VILLAGE TAXES Mayor Falci read the total of unpaid Village taxes - $6421.40. A Motion was made by Trustee Dick to forward all unpaid Village taxes to the county Treasurer to be relevied on the 2012 County/Town tax bill. Motion was seconded by Trustee Libordi and carried.

Trustee Libordi noted that Lowe’s has closed 20 of its underperforming stores. With this he would like to encourage caution as far as the monetary issue of some of the excess spending in contractual accounts. Mayor Falci noted that when a Pilot runs out the Village shares in a percentage of taxes.
